Occupiers of premises owe a duty to keep visitors safe. This duty is imposed by Occupiers’ Liability Act 1957 (OLA 57) which outline their duty towards lawful visitors. However, they may also owe a duty towards trespassers as outlined in the Occupiers’ Liability Act 1984 (OLA 84).
The first video looking at Occupiers Liability. This video focuses on the distinction between a trespasser and a lawful visitor and examines concepts such as the doctrine of allurement and limits to visit such as to time, area and purpose.
The second video looking at Occupiers Liability. This video focuses on the Occupiers Liability Act 1957 - the statute designed to deal with the statutory duty of care that should be given to lawful visitors. It examines the development of the duty, discharging the duty, defences and remedies.
The third video looking at Occupiers Liability. This video focuses on the Occupiers Liability Act 1984 - the statute designed to deal with the statutory duty of care that should be given to trespassers. It examines the development of the duty, discharging the duty, defences and remedies.
